New Hampshire Couple Sues After Slipping on Prosciutto
Slip and fall lawsuits in New Hampshire can occur under a range of different circumstances. While people may assume that slips always occur because of liquid spills, solid items may also cause victims to lose their footing. Such was the case when a New Hampshire woman allegedly slipped on a piece of sliced meat at a market, causing her to suffer serious injuries. Now, she and her husband have decided to sue the property owner responsible for allowing this hazard to exist.
Can Sliced Meat Lead to a Personal Injury Lawsuit?
On August 13th, it was reported that a couple from New Hampshire had sued a marketplace for causing a slip and fall injury. The alleged incident occurred in 2022 when the couple was shopping and taking advantage of various free samples. While walking through the free sample area, the wife slipped on a piece of prosciutto, she claims. While the couple lives in New Hampshire, the incident happened in Boston’s Eataly Market.
The pair are seeking $50,000 in damages for medical costs and loss of consortium. The nature of her injuries is not immediately clear from the media reports, although the wife has apparently spent about $7,500 on various medical expenses as a result of this injury. Perhaps the most notable damage is loss of consortium, which is a non-economic damage. Couples can claim this damage when the injury of one partner puts a strain on the relationship. For example, an injury may prevent spouses from being physically intimate with each other.
Will This Lawsuit Be Successful?
It is not clear whether or not the couple will successfully recover damages as a result of this incident. However, they may encounter a number of issues as they head to court. For example, they must show that the property owner was aware or should have been aware of the hazard prior to the fall. With so many people walking around in the market and enjoying free samples, it may have been impossible for staff members to immediately notice any hazards on the floor. Or, the prosciutto could have landed on the floor just seconds before the fall, making it much harder to successfully argue that the property owner had acted negligently. On the other hand, there may have been similar incidents in the past at this marketplace. If past falls have occurred under similar circumstances, the property owner essentially has no excuse for failing to prevent further injuries.
