Suing A Drunk Driver For A Wrongful Death

WrongfulDeath4

Losing a loved one in a car accident is perhaps one of the most horrifying thoughts for any family member. Unfortunately, New Hampshire residents die in car accidents all the time. Families are left to grieve, pursue justice, and strive for a fair amount of compensation. This isn’t always easy. But when a drunk driver is clearly responsible, proving negligence is relatively straightforward. So what exactly is a wrongful death lawsuit, and how do you receive financial compensation for the death of a loved one?

If you’ve lost a loved one due to a fatal DUI accident in New Hampshire, your first step should always be to get in touch with a qualified, experienced personal injury attorney. With their assistance, you can strive for the best possible results in a highly confident manner. These legal professionals can help you fight for your rights, ensuring you’re not only pursuing justice, but you’re also receiving a fair, adequate settlement that covers your damages. While no sum of money can bring your loved one back, taking legal action can provide a sense of closure and help with future bills, child care costs, and other costs.

Drunk Driver Strikes Toddler in Manchester

On May 22nd, it was reported that a toddler was in critical condition after being struck by a drunk driver in Manchester (1). The boy was 17 months old, and he had run out of his yard before being struck on the road by a Chevrolet sedan. While the boy was quickly taken to a hospital for “potentially serious injuries,” there was no word on his condition in the days following. The driver, however, was arrested for being high on drugs while driving. He also apparently attempted to falsify evidence, for which he was also charged. This could have easily led to a wrongful death lawsuit if the toddler had been killed.

Who Can File a Wrongful Death Lawsuit?

New Hampshire laws govern who can file a wrongful death lawsuit after the death of a loved one. Generally, a lawsuit can be brought on behalf of the estate of the deceased person against the person or organization who caused their death. The claims can include a multitude of different damages including lost wages, pain and suffering, and the person’s death itself.  Additionally, spouses and children of the deceased may have individual claims that can brought.
